3.1 WordPress Web Hosting
• Hosting is provided by a UK-based third-party provider.
• We aim to deliver reliable and high-quality hosting, but please note that third-party provider issues may arise.
3.2 WordPress Website Design & Hosting (Bundled Package)
• We design and host WordPress websites as a combined service.
• Clients must provide branding, text, and media when requested.
• If Fusion Bear adds or sources any additional text or media, the client is responsible for verifying the accuracy and ensuring they have the rights or permissions for that content.
3.3 Paid Support (WordPress Only)
• We offer paid support for WordPress to existing clients.
• This may cover updates, troubleshooting, or minor content changes.
• Any issues arising from plugin conflicts, third-party services, or WordPress updates that significantly alter functionality may require additional costs.
3.4 Email Services
• Email services are offered through our hosting provider, but we strongly discourage relying on this service for business-critical communications.
• We do not provide any direct support for email configuration or troubleshooting.
• Support documentation from our hosting provider can be made available on request.
• Fusion Bear holds zero liability for any loss, delay, or security breach related to email services.
4. Pricing & Payment
• Payments: Handled securely by Stripe. Fusion Bear and Tech Generation staff do not have access to your card details or other sensitive payment information.
• Billing Cycle: Typically monthly or annually, as agreed upon during signup.
• Late Payments: Fusion Bear may suspend or terminate services if payments are overdue.
5. Domain Registration & Transfer
• If you purchase a domain through Fusion Bear, we register it on your behalf.
• During the design phase, if either party chooses to terminate:
• Client-Initiated Termination: The client must pay for the domain. They may transfer it to another provider at their own expense.
• Fusion Bear–Initiated Termination: The client is entitled to one free year of domain registration.
• If a site is launched with administrative access provided to the client, domain costs are non-refundable.
6. Refund Policy
1. Design & Hosting Package
• Full Refund (Minus Domain Costs): Available until you accept the final website design and the site is launched with admin access.
• Once the site is handed over, no further refunds are granted.
• The domain can be transferred to another provider upon request, subject to domain fees.
2. Hosting-Only Clients
• A 30-day money-back guarantee applies.
• After 30 days, no refunds are available.
3. No Other Refunds
• Beyond the specific refund periods and conditions stated, we do not offer additional refunds.
7. Client Responsibilities
• Content & Accuracy: The client is responsible for reviewing all text, images, and other media to ensure accuracy, legality, and proper licensing.
• Branding Materials: The client must provide any necessary logo files, brand guidelines, and other materials in a timely manner.
• Cooperation: Prompt feedback and approvals help us deliver the best possible service.
8. Intellectual Property
• Website Ownership: Once the final design is accepted and launched, the website and its content belong to the client.
• Licensed Media: Any media added by Fusion Bear will be properly licensed. Licensing details can be provided upon request.
• Client Content: You represent and warrant that you own or have permission to use all content provided to Fusion Bear.
9. Liability & Disclaimer
• Limited Liability: Fusion Bear’s maximum liability is capped at the amount you have paid for the service in question.
• No Responsibility for Third-Party Changes: We are not responsible for changes in WordPress core, plugins, themes, domain registrars, or general hosting norms.
• No Liability for Indirect Losses: We are not liable for financial or reputational damage, lost profits, or any indirect losses.
• Email Services Liability: Fusion Bear assumes zero liability for any issues, including security breaches or data loss, related to the email services offered by our hosting provider.
10. Privacy & Data Sharing
• We respect your privacy and do not sell your personal information.
• We may share your details with third-party service providers (such as domain registrars, hosting providers, plugin or license providers) as needed to deliver our services.
11. Termination
• Mutual Right to Terminate: Either party may terminate services in writing at any point during the design phase, following the conditions outlined above for refunds and domain ownership.
• Suspension of Services: Failure to comply with these Terms, including payment obligations, may result in suspension or termination of your services.
12. Changes to These Terms
• We reserve the right to update or modify these Terms at any time.
• The latest version will always be available on the Fusion Bear website.
• Your continued use of our services following any changes constitutes acceptance of the updated Terms.
